This diversity case involved a suit to collect on loans made to fund investments in a horse-breeding limited partnership. Novack and Macey represented Continental Bank as lender. The borrowers asserted a lender-liability defense of fraud in connection with statements about the structure and prospects of the proposed venture. Novack and Macey moved to dismiss all of the lender-liability affirmative defenses and its motion was granted. The Seventh Circuit Court of Appeals affirmed.
