Novack and Macey represented the family of a boy who was killed by his friend with the friend's father's police revolver. A jury found that the police officer had negligently stored his weapon at home and that the City of Chicago was liable on respondeat superior grounds. The trial court upheld the verdict against the officer, but overturned it against the City. In a case of first impression involving the City's responsibility for off-duty storage of weapons at home, the appellate court reversed the trial court's ruling as to the City, and the jury's verdict against the City was reinstated.
