Chase Manhattan Bank made a loan to finance improvements on a real estate project. Sam Zell and his late partner, Robert Lurie, signed personal guarantees of completion. Chase later sued on the guarantees. Novack and Macey represented the guarantors and obtained summary judgement for them in the United States District Court for the Southern District of New York. Chase appealed to the Second Circuit. Steve Novack successfully argued the appeal, and the Second Circuit affirmed the judgement in favor of our clients.
