In a suit filed by other counsel in federal district court in Kansas City, Missouri, certain beneficiaries of an express trust sued their trustees for breach of fiduciary duty. The district court entered summary judgement against the beneficiaries. We were retained by the beneficiaries for the appeal. In an appeal argued by Steve Novack, the Eighth Circuit reversed and remanded the case for trial. Before trial, the case settled.
