On June 27, 2007, Judge Kathleen M. Pantle, of the Chancery Division of the Circuit Court of Cook County, dismissed Novack and Macey’s client from Chaffin v. Platinum Investment Group.
Plaintiff Chaffin alleged that she was the victim of a mortgage rescue scheme that defrauded her of the equity in her home. Novack and Macey’s client, Premier Title, conducted the closing of the sale of Chaffin’s house, but was not alleged to have been involved in the fraud. Judge Pantle dismissed Chaffin’s claims against Premier, finding that “not everyone involved in the transaction is necessarily a perpetrator of [ ] wrongdoing. . . . She cannot seek to hold Premier liable for the fraudulent acts of others by claiming the existence of a fiduciary relationship where no fact support the existence of such a relationship.”
