In a suit seeking more than $15 Million from Novack and Macey’s client, General Growth Properties, Inc., United States District Judge Robert W. Gettleman rejected plaintiff’s claims for violation of the Illinois Consumer Fraud Act and breach of contract. Instead, the Court awarded damages, attorneys’ fees and expenses to General Growth for its counterclaims of breach of contract and maker’s liability under the Uniform Commercial Code.
General Growth is the country’s second largest shopping center owner, developer and manager. The Plaintiff, We Deliver America, Inc., is a marketer that leased common space in 125 General Growth malls for a marketing program.
