Novack and Macey’s Client Prevails against Insurance Company Seeking Reimbursement of Defense Costs

On August 1, 2005, Judge David R. Donnersberger held that Novack and Macey’s client, Valuemetrics, Inc., did not have to repay Tudor Insurance Company for defense costs Tudor paid on behalf of Valuemetrics. The case had its origin in Valuemetrics’ successful defense of a complaint filed against it in federal court. Tudor paid Valuemetrics’ defense costs, but the Illinois Appellate Court held that Tudor was not obligated to defend Valuemetrics. Tudor then sought reimbursement from Valuemetrics. Eric Macey and Tim Miller of Novack and Macey moved to dismiss Tudor’s complaint for reimbursement. Interpreting a very recent Illinois Supreme Court opinion, General Agents Insurance Co. of America, Inc. v. Midwest Sporting Goods Co., 215 Ill. 2d 146 (2005), Cook County Circuit Court, Judge David Donnersberger held that because Tudor’s insurance policy did not grant it a right of reimbursement, Valuemetrics did not have to reimburse Tudor.
