Eric Macey and Richard Miller, on behalf of Stayhealthy, Inc., overcame summary judgment motions brought by AmerisourceBergen Corporation and Petters Company, Inc. in the United States District Court for the District of Minnesota. In a lawsuit originally filed by Petters, Stayhealthy filed counterclaims contending that Petters made false statements and promises to Stayhealthy that caused millions of dollars in damages. Stayhealthy has also alleged that ABC breached multi-million dollar agreements it had with Stayhealthy. In a written Memorandum Opinion and Order, United States District Judge John R. Tunheim refused to grant ABC and Petters summary judgment on those claims. The Court also dismissed, with prejudice, Petters’ claims that ABC and Stayhealthy had violated Federal Anti-Racketeering laws.
