April 8, 2004 – Karen L. Levine and Steve Ciszewski on behalf of Old Republic Insurance Company won two motions today in the United States Federal District Court for the Northern District of Illinois, in the case entitled Old Republic v. Ness Motley et al. The Court, in a written Order and Memorandum, denied the Defendants’ motion to transfer the case to the United States District Court for the District of South Carolina. It so doing, the Court found that the Defendants failed to carry their burden of showing that South Carolina was a more convenient forum. The Court also found that the “majority of the factors weigh[ed] against transfer or [were] neutral [on the issue].” The Court further denied the motion to dismiss brought by one of the Defendants based on the Court’s alleged lack of personal jurisdiction over him.
