In March 2008, Novack and Macey partners Mitchell Marinello and Richard L. Miller II tried a copyright infringement case involving hundreds of fabric designs in the Northern District of Illinois before the Honorable David H. Coar.  The case was favorably settled during the first day of the trial after Marinello had delivered his opening argument and while Miller was examining the firm's key witness.  The case also served as a catalyst for resolving two other copyright infringement cases that were pending between related parties in federal court in New York.
