Richard Douglass has a broad commercial litigation practice that has, of late, increasingly focused in the energy sector. He represents alternative energy providers, wholesalers, and other entities engaged in energy commodities involved in disputes over commodities valuation, breach of contract issues, collections, and purchase and sale agreements. He has also represented an investor in oil and gas lease partnerships in fraud matters.
In one energy-related case, Richard represented a company involved as the seller in a wholesale energy supply agreement. A dispute arose when the energy market switched to new set of governing rules, termed "standard market design," or SMD. The parties differed in their interpretation of their contract as to which party was responsible for new SMD-related costs. A bench trial resulted in a $2.65 million judgment in favor of Richard's client.
Richard has substantial real estate experience, primarily defending developers against claims of construction defects, breach of fiduciary duty, and failure to disclose, among other claims. He has defended directors of a publicly traded company in the computer industry against claims of fraud.
Richard's practice is geographically varied. In addition to Illinois, he has handled cases in Connecticut, New York, North Carolina, Florida, Missouri, and other locales. He is also a member of the Illinois State and American Bar Associations. Before joining Novack and Macey, Richard was an associate at Fortson, Bentley and Griffin, PA in Athens, Georgia.
Richard grew up in Wheaton, Illinois. He and his wife, Jennifer, reside in Chicago.
